Failure to receive samples at the laboratory within 6 calendar days from collection, including shipping and shipping delays.

Laboratory Analysis:

Our third-party laboratory will analyze your menstrual fluid sample for the presence of HHV-6A. This testing process is conducted under strict laboratory conditions to ensure the accuracy and reliability of your results.

Results Reporting:

Once your sample has been analyzed, the results will be uploaded to our secure, HIPAA-compliant customer portal. You will receive a notification that your results are available and can securely access them through the portal.

Process for Resolving Disputes

Initial Contact: If you have any concerns or disputes related to our service, we encourage you to first contact our customer support team. Many disputes can be resolved quickly by communicating directly with us. We aim to understand your concerns and seek a satisfactory resolution.
Formal Complaint: If your issue cannot be resolved through initial contact with customer support, you may submit a formal complaint. Please provide a detailed description of your dispute, including any relevant documentation or correspondence, and propose your desired outcome. This complaint can be submitted via the secure customer portal or through our designated customer service email.
Internal Review: Upon receiving your formal complaint, it will undergo an internal review by Fertility Phoenix LLC. We are committed to reviewing each case thoroughly and fairly, in accordance with our policies and the terms outlined herein.
Mediation: If the dispute cannot be resolved through our internal review process, both parties agree to enter into mediation with a mutually agreed-upon mediator, before resorting to arbitration or litigation. The goal of mediation is to reach a voluntary agreement between Fertility Phoenix LLC and the customer under the guidance of a neutral third party.
Binding Arbitration: In the event that mediation does not resolve the dispute, either party may request that the dispute be resolved through binding arbitration. The arbitration will be conducted in accordance with the rules of the American Arbitration Association and will take place under the laws of the State of Delaware. This arbitration process is intended to provide a final and binding resolution to the dispute.

Governing Law and Jurisdiction

Governing Law: These Terms and Conditions and any disputes arising under them will be governed by the laws of the State of Delaware, without regard to its conflict of law provisions.
Arbitration Location and Rules: Any dispute resolution proceedings, whether in arbitration or court, will be conducted exclusively under the laws of the State of Delaware. The arbitration itself will be administered by the American Arbitration Association, ensuring that both parties have access to a fair and neutral arbitration process.

Fertility Phoenix LLC is dedicated to maintaining a positive relationship with our customers and addressing any concerns that may arise during the use of our services. By agreeing to these terms, you are committing to resolve any disputes through this established process, emphasizing mediation and arbitration as preferred methods before any litigation.

Cancellation and Refund Policy

Fertility Phoenix LLC aims to provide flexibility and fairness in our cancellation and refund policy, understanding that circumstances can change. Below outlines the conditions under which customers can cancel their order and the refund policy for cancelled orders or unsatisfactory service.

Conditions for Order Cancellation

Unused Covee Collection Kit: Customers who have ordered but not used their Covee collection kit have 30 days from the time of order to request a refund. All orders over 30 days are considered final and cannot be cancelled or refunded.
Used Collection Kits: If the collection kit has been used or the sample has been sent to the laboratory, no refunds can be issued. The nature of our service and the costs incurred once a kit is used prevent us from offering refunds in these situations.

What Happens if Sample is Rejected

Steps after sample Rejection: A sample may be rejected by the laboratory for reasons listed above in the “Reasons for Rejection of Sample” under the clause, “Description of Service”. In the event that this happens, Fertility Phoenix will send a replacement Covee, and the user will need to collect another sample during their next menstrual cycle.

Refund Process

Requesting a Refund: To initiate a refund, customers should first contact Fertility Phoenix LLC by emailing info@fertilityphoenix.com or through their secure customer portal. Please include your order number, the reason for the refund request, and whether the kit has been opened.
Returning the Kit: Refunds will only be processed after the unused Covee collection kits are received back at the address provided during the refund process. Detailed instructions for returning the kit, including the return address and any required documentation, will be provided upon receipt of the refund request.
Important Note: If you wish to return the collection kit for a refund, do not use the prepaid FedEx mailer included in Covee. The prepaid mailer contained within is intended for sending your collected sample to the laboratory, not for returning the kit to Fertility Phoenix LLC.
Reimbursement Amount: Customers will be reimbursed the amount received by Fertility Phoenix LLC.

Entire Agreement

This Terms and Conditions document, along with any documents referenced herein, including but not limited to the Privacy Policy, HIPAA Notice and a Consent Form, constitutes the entire agreement between you, the customer, and Fertility Phoenix LLC regarding the services provided. This agreement supersedes all prior agreements, understandings, negotiations, and discussions, whether oral or written, between the parties regarding the subject matter herein.

By using the services provided by Fertility Phoenix LLC, you acknowledge and agree that:

These Terms and Conditions, along with any documents referenced within, represent the sole and entire agreement between you and Fertility Phoenix LLC with respect to the services offered, the use of those services, and any other related matters.
No other representations, inducements, promises, or agreements, orally or otherwise, regarding these matters, have been made by either party or anyone acting on behalf of either party, which are not embodied herein.

Any modifications to this agreement must be made in writing. Fertility Phoenix LLC reserves the right to update or change these Terms and Conditions and any referenced documents at any time, as outlined in the “Amendments to the Terms and Conditions” section. Your continued use of the services following any such changes will constitute your acceptance of the new Terms and Conditions.
